Recently I've been given a wonderful TB mare. The mare is a rehabilitated lady from a rescue operation. The person who adopted her after her recovery from starvation had gone through an unforseen divorce and gave the mare to a friend. The friend found me through a mutual acquaintance and gave me the mare after many discussions, phone and internet. I am fully intending to keep the horse. However, I was wondering who really owns her leagally? Registration papers (Jockey club) didn't follow her starvation episode. I don't have a bill of sale because she was a gift. She is a great lady who deserves the best care I can give to her. I just don't want a trailer to show up at the stable and haul her away legally. Any advice?

I would ask the person who gave her to you to "sell" her to you for a $1 and to give you a signed bill of sale. You can create your own very simple document. Be sure to include as much description/identification on the horse as you can, including registered name, nick name, age, height, all marks, scars, tattoos, etc. Say you need it for your records in case you ever have to prove chain of custody. This person should get the same type of bill of sale from the divorced friend... but that's his/her problem. Attached is a bill of sale I found on the Internet.

I had to call out the brand inspector on a horse that was given to me, who was given to someone before me. Because i couldn't prove the horse was mine, I had to have the person who gave the horse to me, go back to the person who gave the horse to her and sign a bill of sale or a note stating she was sold/given to... and all her marks as she wasn't branded, then the gall who gave her to me had to do the same thing. It's all in the paper trail.
