Posted on Tuesday, Sep 23, 2003 - 10:08 am: Kari,This is our form which we got from a Florida Site. I can't remember exactly but they have all sorts of agreements and contracts. Mostly generic and then you add or delete stuff pertaining to you. Below I copy and pasted ours. It might be outdated we did it in 2000, but should give you an idea. We also do a lease agreement. We found that we can't evict non-payers, etc without a written lease agreement. I don't know if this would pertain to your state, or if its just because the barn is owned by a homeowner association and not just one person. joj BOARDING AGREEMENT This Agreement is made between and/or (Hereafter referred to as "Stable") located at, and (Hereafter referred to as "Lessee(s) [print tenant’s name(s)] and/or Horse Owner(s)") residing at Stall #_________, owner/responsible party of the horse described in Section 2. 1. Fees a) Term and Rent: In consideration of $_______________ per horse per month paid by Lessee(s) and/or Horse Owner(s) in advance on the first day of each month on a month to month term, the Stable agrees to board said horse commencing ____/____/1999. Late fees in the amount of $15.00 will be applied for amount due not paid by the 5th of the month. Notice for delinquent rent will be posted in writing on your stall, hand delivered to you, and/or mailed to your home. b) Security and/or Damage/Stall Preparation Deposit: The Lessee(s) and/or Horse Owner(s) shall deposit with Stable on the signing of this boarding agreement the sum of $75.00 as Security and/or Damage/Stall Preparation Deposit as deposit for the performance of Lessee(s) and/or Horse Owner(s)’s obligations under this boarding agreement, including without limitation, the surrender of possession of the premises to Stable as herein provided. If Stable applies any part of the deposit to cure any default of Lessee(s) and/or Horse Owner(s), Lessee(s) and/or Horse Owner(s) shall on demand deposit with Stable the amount so applied so that Stable shall have the full deposit on hand at all times during the term of this boarding agreement. Upon vacating the premises for the termination of this lease, Stable shall return to the Lessee(s) and/or Horse Owner(s) the Security and/or Damage/Stall Preparation Deposit less any amount of claim. If Lessee(s) and/or Horse Owner(s) vacate the stall in the same condition as when it was leased save usual wear and tear, Stable will refund the deposit to the Lessee(s) and/or Horse Owner(s). The stalls are prepared with bedding for new tenants and must be left in the same condition and standard with fresh unused bedding as was used when Lessee(s) and/or Horse Owner(s) first leased the stall. c) Options to the basic fee paid in the same timely fashion are available as listed below. Each additional requested service must be circled and initialed by the Lessee(s) and/or Horse Owner(s). These options can be changed at any time Stable receives written notice from Lessee(s) and/or Horse Owner(s) or if Lessee(s) and/or Horse Owner(s) receives written notice from the Stable. The fees are subject to change given (N/A at this time) days written notice by Stable. 1) N/A at this time $ 2) $ 3) $ 2. Description of the Horse Name Age Color Sex Breed Height Registration/Tattoo Markings 3. Turn-Out: If no options are chosen, the Lessee(s) and/or Horse Owner(s) will be expressly responsible for all exercise and it is understood that the horse (will not) be turned out. 4. Standard of Care: All care is provided by Lessee(s) and/or Horse Owner(s), with exception of morning feeding and watering. Optional Special Instructions Not applicable at this time. 5. Risk of Loss: While this horse is boarded at Stable, Stable shall not be liable for any sickness, disease, theft, death or injury suffered by the horse(s) or any other cause of action arising, from or connecting to the boarding of this horse. All risks are assumed by the Lessee(s) and/or Horse Owner(s). The Lessee and Horse Owner(s) agrees to hold Stable harmless from any loss or injury to said horse(s). All costs, no matter how catastrophic, connected with boarding are borne by Lessee(s) and/or Horse Owner(s). 6. Indemnity: Lessee(s) and/or Horse Owner(s) agrees to hold Stable harmless from any claim caused by said horse(s) and agrees to pay legal fees incurred by Stable in defense of a claim resulting from damage by said horse(s). 7. Emergency Care: If medical treatment is needed, Stable will attempt calling Lessee(s) and/or Horse Owner(s) but, in the event Lessee(s) and/or Horse Owner(s) are not reached, Stable has the authority to secure emergency veterinary and/or farrier care. Lessee(s) and/or Horse Owner(s) are responsible to pay all costs relating to this care. Stable is authorized as Lessee(s) and/or Horse Owner(s)'s agent to arrange billing to the Lessee(s) and/or Horse Owner(s). 8. Ownership - Coggins Test: Owner warrants that he owns the horse and will provide, prior to the time of delivery, proof of a negative Coggins test. 9. Use of Premises: Lessee(s)/Horse Owner(s) shall use and occupy the premises/stall for equestrian recreational use only. The premises shall be used for no other purpose, unless Lessee(s) and/or Horse Owner(s) is notified in writing by the Board of Directors of Saddle Up Townhomes. Lessee(s) and/or Horse Owner(s) shall comply with all rules set forth by the Stable and appropriate governmental authorities. 10. Alternations: Lessee(s) and/or Horse Owner(s) shall not, without first obtaining the written consent of the Stable, make any alterations, additions, or improvements, in, to, or about the premises. 11. Ordinances and Statutes: Lessee(s) and/or Horse Owner(s) shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities not in force, or which may hereafter be in force, pertaining to the premises, occasioned by or affecting the use thereof by Lessee(s) and/or Horse Owner(s). 12. Vehicle Parking: Lessee(s) and/or Horse Owner(s) agrees to park in visitor parking areas and not to park or drive their vehicle inside barn premises unless loading and unloading horse(s) or effects. Lessee(s) and/or Horse Owner(s) agrees when on barn premises with vehicle for the purpose of loading and unloading, such will be done so with proper haste. Lessee(s) and/or Horse Owner(s) agrees not to leave their car parked on the barn premises unattended for any unreasonable amount of time. 14. Assignment and Subletting: Lessee(s) and/or Horse Owner(s) shall not assign this boarding agreement or sublet any portion of the premises without prior written consent of the Stable. Any such assignment or subletting without consent shall be void, and, at the option of the Stable, may terminate this boarding agreement. 15. Stable’s Remedies on Default: If Lessee(s) and/or Horse Owner(s) defaults in the payment of rent, or any additional rent or late fees, or defaults in the performance of any of the other covenants or conditions hereof, Stable may give Lessee(s) and/or Horse Owner(s) notice of such default and if Lessee(s) and/or Horse Owner(s) does not cure any such default within five days, after the giving of such notice, then Stable may terminate this agreement on not less than five days’ notice to Lessee(s) and/or Horse Owner(s). On the date specified in such notice this agreement shall terminate, and Lessee(s) and/or Horse Owner(s) shall then quit and surrender the premises to Stable, but Lessee(s) and/or Horse Owner(s) shall remain liable for monies owed. If this lease shall have been so terminated by Stable, Stable may at any time thereafter resume possession of the premises and retain horse(s) and their effects by any lawful means. (see Right to Lien) No failure to enforce any term shall be deemed a waiver. In case suit should be brought for recovery of horse(s), or for any sum due hereunder, or because of any act which may arise out of the possession of the horse(s), by either party, Lessee(s) and/or Horse Owner(s) agree to hold Stable harmless from any claim and agrees to pay legal fees incurred by Stable in defense of a claim resulting from suit. 16. Termination: Either party may terminate this agreement. In the event of a default, the wronged party has the right to recover attorney's fees and court costs, resulting from this failure of either party to meet a material term of this agreement. 17. Notice: Lessee(s) and/or Horse Owner(s) agree to give Stable thirty (30) days notice to terminate this agreement. The Lessee(s) and/or Horse Owner(s) cannot assign this agreement unless the Stable agrees in writing. 18. Right of Lien: Stable has the right of lien as set forth in the law of the State of Florida for the amount due for board and additional agreed upon services and shall have the right, without process of law to retain said horse(s) until the indebtedness is satisfactorily paid in full. 19. Rules and Regulations: Lessee(s) and/or Horse Owner(s) acknowledges that he/she has received a copy of the Barn Rules and Regulations and agrees to abide by such article. The forgoing constitutes the entire agreement between parties and may be modified only by a written agreement signed by both parties. This agreement is subject to the laws of the State of Florida.
