I have had my horse up for sale for several months now. A potential buyer wants to lease him first. I printed out the sample contract. How long is the usual term of a lease and how much are horses leasing for? Woody is a 7 year old TB/QT horse trained in English - mostly flatwork, but started over fences to about 2'. Is it usual for the lessee to cover the horse insurance, or the lessor?

Sonya, any and all of those issues can be put in the lease however you would like them. I had Rachel Kosmal McCart from Equine Legal Solutions draw up a wonderful lease for me when I worked at a ranch here. The lease is comprehensive and well-done. You can find help at: www.equinelegalsolutions.com

Is the horse leaving your care? You will want an iron clad lease that spells out type of insurance needs that is to be carried and who is the beneficiary if the horse dies or becomes unusable. I have seen to many sale horses go away "on trial" and come back with new problems. Be sure to protect yourself in writing.

Sonya, See if you can include some mention about the horse being returned in the same mental condition as well as physical. I does seem rather subjective but it is such an important condition for a horse and it is almost as important as physical health.

Holly, the legal web site looks very helpful, thanks. I'm having serious doubts about leasing my horse the more I look into it. It looks like too much could go wrong! If I did choose to lease, does one charge the lessee monthly or what and how much?
