I recently aquired a horse that was bread before I bought her. There were no previous agreements about the colt if the horse was pregnant. Who does the colt belong to?

Was it ever suggested she was pregnant? If not I think he is all yours.

Re: pregnant horse. 1. Was there any contract on the sale of the horse? 2. If there was a contract was it oral or in writing? 3. Did the contract mention the horse being pregnant or that possibility? If not, then the horse is yours, in my opinion. And even if the contract did mention any of these I would like to consider any mentions carefully; the issue could still be yours. gerald goulder

I was thinking more about the pregnant horse; two additional thoughts. First, the rule on a live foal is "stand and nurse", so wouldn't the ownership not exist (absent other agreement) until foal stands and nurses? Also, do we really exp[ect seler will pay for any of the current and continuing expenses of the foal after birth? I still say the foal is yours.

I am selling a mare that is in foal but whan the foal when it is weaned(6mths) is to be mine. Does anyone know of a sample agreement that addresses this type of situation.
