A few years ago I was threatened with a lawsuit when a woman with a cardiac pacemaker reached across our electrified fence to pet our horses. She got a shock and experienced serious health problems for several days. I found that posting the fence with a traditional sign every 200 feet did not relieve me of all liability. Horses can be classified as an attractive nuisance in areas of easy access. Fence marking laws exist at various levels in different states. Fence owners are charged with the total responsibilty to warn people, especially children, about the shock hazard. Luckily, the woman decided not to sue. After the incident, I developed a pictographic fence marking kit that allows children and others who may not read or understand English, to be warned about the shock hazard and avoid touching the electrified fence. There are many people with pre-existing health conditions that should NOT recieve electrical shocks!! (As an added benefit, the tags hanging directly on the hot wire, identifies the location of the wire for your critters as well!) See my website at {https://waupaca.8k.com/xtatic.htm for details OR search for Julie I Fershtman's law article called "Avoiding the Attractive Nuisance". It's a real eye-opener. If any of you have experienced similar problems with uninvited visitors and your electrified fences, I'd appreciate hearing from you. HAPPY TRAILS!!
