Posted on Friday, Jul 21, 2000 - 9:44 pm: I sent my then two year old colt to a handler last spring to get him prepared to show in hand. To make a long story short while he was there he was bred WITHOUT MY PERMISSION to a mare a client of the handler's owns. When I confronted the person I tape-recorded the conversation in which he admitted the breeding took place - but he claimed it was accidental. I was assured the mare was checked and was not in foal. I found out this week that indeed the mare did get in foal and gave birth to a colt in early May. The guy is trying to say that the foal was sired bya 1/2 brother of my stallion that he purchased 2 months after I removed my colt from his care. He is also lying about the foaling date on the baby by almost 2 months (again I have proof of when the foal was born vs. what he claims). He obviously adjusted the delivery date to accommodate the timing in getting the 1/2 brother. He has filed registration paperwork that he has falsified - with both the sire's name and the date of foaling. What sort of recourse do I have here? I cannot bear the thought of this man raising a foal by my stallion so I want to fight this. This is also not the oly dishonest thing he has gotten away with in the last year so I do not want him to think what he's doing is OK. Secondly - how do I find a good lawyer who specializes in this type of case? Thank in advance... |

Posted on Saturday, Jul 22, 2000 - 8:32 am: Dear Karen,I've never seen a case like yours before, but it seems to me your best shot would be to start with the organization with which the foal was registered. The various registries in the US have really been cracking down on this sort of thing and with the ability to DNA test now, the case is definitely provable. Also, with proof that the foal was sired by your colt, I would think you would have a much stronger case if/when you took this guy to court. Just a thought. Good luck and keep us posted! Nancy |

Posted on Thursday, Aug 17, 2000 - 6:32 pm: You can turn the guy into the organization as possible fraud. They might request a DNA test. Some cases, the horse's registration papers are put on hold UNTIL the DNA test has been done. Since you own the stallion that might have been bred...you have a lot of pull... |
