Discussion on Is prospective buyer liable for horse enroute for prepurchase exam | |

Posted on Monday, Jun 4, 2001 - 8:38 pm: I(buyer) have agreed on purchase price with seller and am vetting horse tomorrow.However the horse is being trailered to stable where my vet has agreed to do the exam(approx. 45 miles)In the event of accident enroute who is liable for injuries sustained or death? I also am requesting a drug test and am told that I can take possesion of horse before results and can write into Bill of sale that if test comes back positive that they have to refund money... Better to wait until results are in before writing check? |

Posted on Tuesday, Jun 5, 2001 - 6:18 am: I just purchased a broodmare with foal by her side and was allowed to have her vanned to my home not only for vetting, but before I had actually "bought" her. The only stipulation the seller had - and I believe it was a reasonable one - was that I carry insurance for the purchase price naming the seller as beneficiary. This way, if something happened, the cost wouldn't be out of my own pocket, but they didn't lose out either. Of course, the premium was my responsibility as it was my choice to move the horse.Nearly all of the equine insurance agencies - either local or listed in any of the equine magazines - can provide you with reasonable "temporary" insurance, as it is utilized all the time for several reasons, one of which is the very reason you state. If you don't want to go the insurance route, be VERY SURE that EVERY SINGLE PARTICULAR CONCERNING POSSIBLE ACCIDENT AND/OR ILLNESS RESPONSIBILITY is CLEARLY defined IN WRITING AND SIGNED BY ALL PARTIES CONCERNED!!! This is a very dangerous area economically to leave up in the air. Good luck. Bonnie |
